The Ledger Law Firm realizes that patients are suffering life-altering infections and disabilities suspected to be as a result of medical facilities using the Bair Hugger in spite of warnings from its own inventor. Now patients are coming forward to seek compensation from their suffering as a direct result of the Bair Hugger warming blanket. The Ledger Law Firm may be able to help you by handling your Bair Hugger Lawsuit claim.
Scott D. Augustine, MD, developed the Bair Hugger warming blanket in 1988 to warm patients after surgery. He later questioned the safety of the Bair Hugger, even calling for it to be taken off the market. Patients became ill, suffering massive infections and life-altering disabilities after his warnings went ignored by Arizant Healthcare, the company that marketed the Bair Hugger. Augustine left the company in 2002 after a dispute with the company.
In 2010, 3M purchased Arizant and continued marketing the Bair Hugger. In that same year, Scott Augustine publicly sounded the warning of his own creation, announcing that it posed dangers to patients when used to warm patients after surgery. In December 2010, the New York Times sounded the alarm, stating details of the warning against using the Bair Hugger. Originally developed because Augustine asserted that warming patients with the Bair Hugger would reduce post-operative complications such as bleeding and lead to faster healing, he now asserted that the device posed a danger to patients because the Bair Hugger worked by carrying forced, warm air through a hose to the actual Bair Hugger blanket, warming the patient. Augustine’s position is that it is the forced air that caused the problems with the device.
Dr. Augustine said that the forced air carried to the blanket posed the risk of carrying bacteria through the hose and into the blanket, raising the risk of infection to patients.
Even after developing a new warming blanket device, the HotDog Patient Warming System, hospitals kept using the Bair Hugger and Arizant/3M kept the device on the market to medical facilities. Even after patients began suffering from hospital-acquired infections, the Bair Hugger was still used.
In 2013, the first lawsuit claim was filed on behalf of Timothy Walton, a 70 year-old Texas man who, had to have his artificial hip removed after suffering infections allegedly related to the Bair Hugger. After the filing of that lawsuit, a 3M spokesperson said they were “very confident” regarding the safety of the Bair Hugger. In 2010, after its own inventor voiced claims that the device, Arizant responded to his warnings with the statement, “Augustine’s allegations against forced-air warming stem from a personal vendetta and are baseless.”
Scott D. Augustine wrote about the dangers posed by forced-air warming (FAW) devices in his 2013 article, “FORCED-AIR WARMING IN ORTHOPEDIC SURGERY: BENEFIT OR DANGER?” He proposed that “The implantation of foreign material in the body fundamentally changes the pathophysiology of the infectious process,” and that “it has been shown that a single bacterium can cause a peri-prosthetic joint infection (PJI), and it usually enters the wound as airborne contamination. Still the Bair Hugger stayed on the market.
Today, many patients are suffering life-altering disabilities alleged to be as a direct result of contamination from the forced-air Bair Hugger. If the claims are substantiated, the suffering and disabilities to patients should not have happened, especially with the multiple warnings sounded by its own creator, Dr. Scott Augustine, MD. The company selling the Bair Hugger has not admitted any liability nor recalled their device. That is why the Ledger Law Firm, a nationally recognized personal injury firm, announced that their dedicated attorneys are vetting & accepting claims related to the Bair Hugger forced-air warming system.
